Terms of Service

By using Prodigy you agree to these terms. Prodigy is operated by Hodgen AI ("we"). Contact mike@hodgen.ai for questions.
1. Eligibility
You must be 18+ and the parent or legal guardian of the child whose information you enter. You may not use Prodigy on behalf of someone else's child without their explicit written consent.
2. Medical disclaimer — important
Prodigy is not medical advice.
All content — daily activities, milestone predictions, pediatrician summaries, vision assessments — is educational content generated by AI for informational purposes. It is not a diagnosis, not a substitute for clinical evaluation, and not a recommendation for any medical treatment. Always consult your pediatrician about your child's development, particularly if anything concerns you. In an emergency, call 911 or your child's doctor immediately.
3. Subscriptions & billing
- Paid plans (Pro, Family, Prodigy) are billed monthly or annually via Stripe.
- New subscriptions include a 7-day free trial. Cancel anytime during the trial to avoid charges.
- You can cancel, upgrade, or downgrade from Settings → Billing. Cancellation takes effect at end of current billing period.
- Refunds are evaluated case-by-case. Email mike@hodgen.ai.
- Prices may change with 30 days' notice to existing subscribers.
4. Acceptable use
You agree not to:
- Reverse-engineer, scrape, or resell any part of the service.
- Use Prodigy to generate content about a child without parental consent.
- Upload illegal content or content that violates another person's privacy.
- Abuse rate limits or attempt to bypass plan quotas.
5. User content
You retain ownership of all data you enter (child profile, notes, uploaded videos). You grant us a limited license to process it solely to provide the service. We never sell or share user content with advertisers.
6. AI-generated output
Activities, reports, and predictions are generated by AI models and may contain errors. You are responsible for reviewing AI output before relying on it. Do not treat AI output as medical, legal, or financial advice.
7. Assumption of risk & supervision
Activities involve real-world physical risk. You are the supervisor.
Prodigy generates activity suggestions, not directives. Some activities involve one or more of the following hazard categories:
- Water (splashing, bath, sensory play with liquids)
- Elevation (pillows, furniture, climbing, pulling to stand)
- Food & choking hazards (especially for children under 3)
- Small parts that could be mouthed or swallowed
- Heat sources, warm water, steam
- Sharp edges or tools
By using Prodigy you acknowledge and agree that: (a) you are the parent or legal guardian of the child on the account; (b) you are solely responsible for continuous, direct supervision of every activity; (c) you are responsible for preparing a safe environment (securing furniture, removing choking hazards, using harnesses/straps, testing water temperatures, etc.); (d) you are responsible for choosing which activities are appropriate for your specific child's age, abilities, and health; and (e) you assume all risk of injury, loss, or harm that occurs while following, adapting, or being inspired by a Prodigy suggestion.
8. Indemnification
You agree to defend, indemnify, and hold harmless Hodgen AI, its operators, employees, and contractors from any claim, liability, damage, cost, or expense (including reasonable attorneys' fees) arising out of or related to (i) your use of Prodigy, (ii) any activity you conducted with your child based on a Prodigy suggestion, (iii) your violation of these Terms, or (iv) your violation of any third-party right including any child's right to privacy or safety.
9. Limitation of liability
To the maximum extent permitted by law, Prodigy's total liability for any claim arising out of or related to the service is limited to the fees you paid in the 12 months preceding the event. We do not warrant that the service will be uninterrupted, error-free, or suitable for any particular child. Prodigy is not liable for any injury, illness, developmental outcome, emotional distress, or other harm suffered by a child or caregiver in connection with a suggested activity.

Copyright notices can be sent to mike@hodgen.ai with subject line "DMCA".
11. Changes
We may update these terms. Material changes will be notified by email 30 days in advance. When the safety acknowledgment language in §7 changes materially, you will be asked to re-acknowledge on your next login.
12. Governing law
These terms are governed by the laws of California, USA, excluding conflict-of-law rules.
